Terms

Our Terms & Conditions

These are the terms on which you may use the Project Lawyers website at projectlawyers.com.au (the “website”). They form an agreement between you and Project Lawyers Pty Ltd (“Project Lawyers”, “we”, “us”, “our”).

By accessing or using the website, you accept these terms. If you do not accept them, please do not use the website.

These terms cover the website only. They are not our terms of engagement. If we act for you on a matter, the terms of that engagement are set out separately in a costs agreement and disclosure statement provided to you under the Legal Profession Uniform Law (NSW). Nothing on this page varies, limits or replaces those terms.

The website provides general information about our firm, our practice areas, our people, and developments in the areas of law we work in.

It is published for general information only. It is not a substitute for legal advice.

No.

Nothing on this website is legal advice, and nothing on it is intended to be relied on as legal advice. General information cannot account for your circumstances, and the law is rarely as simple as a summary makes it appear.

Legal outcomes turn on specific facts. Two matters that look identical on the surface can resolve very differently. If you have a legal issue, get advice on your actual situation before you act — from us or from another lawyer.

Do not delay obtaining advice, or refrain from obtaining it, because of something you have read here. Many legal rights are subject to strict time limits, and those limits are not extended because you were relying on a website.

No. Using the website, reading our publications, or sending us an enquiry does not create a solicitor-client relationship between you and Project Lawyers.

We act for you only once we have agreed to act, completed our conflict of interest checks, and you have accepted our costs agreement. Until that happens, we are not your lawyers and we owe you none of the duties that a solicitor owes a client.

Please don’t — not until we have agreed to act for you.

Information you send us before we are engaged may not be treated as confidential or privileged, and we may already be acting for another party with an interest adverse to yours. We cannot know that until we have run a conflict check.

If you want to talk to us about a matter, send us your name, your contact details and a brief, general description of the issue. Once we have confirmed there is no conflict and we are able to act, we will tell you and you can give us the detail.

We cannot guarantee the security of information transmitted over the internet or by email. Please do not send anything sensitive through the website’s contact form.

We try to keep the website current, but the law changes — sometimes quickly, and often without much warning.

Articles and publications on this website reflect the law as we understood it at the time they were written. They are not updated as the law develops, and the date on an article tells you when it was written, not that it remains accurate. Legislation is amended, cases are overturned on appeal, and policy positions shift.

We make no representation that the website is complete, current or free from error.

The website is directed at people in New South Wales and elsewhere in Australia. Our practice is in NSW, and the material on the website is written by reference to NSW and Commonwealth law.

If you access the website from outside Australia, you do so on your own initiative, and you are responsible for complying with the laws of your own jurisdiction. Nothing on the website is intended as advice about the law of any other place.

We do, or we use it under licence. All content on the website — text, articles, publications, images, graphics, logos, the Project Lawyers name and logo, page layouts and design — is protected by copyright and other intellectual property laws.

Legislation and case law referred to or linked on the website remains subject to its own copyright and licensing arrangements.

You may read, print and download material from the website for your own personal or internal business use, provided you keep all copyright and other notices intact.

You may not, without our prior written consent:

  • Reproduce, republish or distribute our content commercially
  • Adapt or modify our content
  • Present our content as your own, or remove attribution
  • Frame the website or any part of it within another site
  • Use our name, logo or trade marks
  • Use automated means to scrape, harvest or copy content from the website
  • Use our content to train or develop a machine learning or artificial intelligence system

You may link to the homepage of the website, provided the link is not misleading and does not suggest any endorsement, sponsorship or association that does not exist. We may ask you to remove a link at any time.

You must not use the website:

  • In any way that breaches any law
  • To transmit any virus, malicious code or harmful material
  • To gain or attempt to gain unauthorised access to the website, its servers, or any connected system
  • To interfere with the website’s operation or another user’s access to it
  • To send unsolicited commercial communications
  • For any fraudulent or deceptive purpose

We may restrict or terminate your access to the website at any time, without notice, if we consider your use inappropriate.

The website links to external sites — including legislation databases, courts, tribunals and government agencies — for your convenience.

We do not control those sites, we are not responsible for their content or availability, and a link is not an endorsement of the site, its operator, or anything on it. Your use of a linked site is subject to that site’s own terms.

We do not guarantee it. The website may be unavailable at times due to maintenance, technical issues, or circumstances outside our control.

We may change, suspend or withdraw the website or any part of it at any time, without notice and without liability.

To the maximum extent permitted by law:

  • The website and its content are provided on an “as is” basis, without warranties of any kind, whether express or implied
  • We exclude all liability for any loss or damage arising out of or in connection with your use of, or reliance on, the website or its content — including indirect or consequential loss, loss of profit, loss of opportunity, and loss or corruption of data
  • We are not liable for any loss arising from the website being unavailable, or from any virus or harmful code transmitted through it

Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Competition and Consumer Act 2010 (Cth) or any other law that cannot lawfully be excluded. Where we are permitted to limit rather than exclude our liability, our liability is limited to resupplying the relevant services or paying the cost of having them resupplied.

Liability limited by a scheme approved under Professional Standards Legislation.

Our Privacy Policy explains how we collect, hold, use and disclose personal information, including information collected through this website. It forms part of these terms.

Yes. The website uses cookies and similar technologies to make the site function, remember preferences, and understand how the site is used. Details are in our Privacy Policy. You can control cookies through your browser settings, though some parts of the site may not work properly if you disable them.

Yes. We may amend these terms at any time by publishing an updated version on this page. The date at the top tells you when they were last updated.

Changes take effect when published. Your continued use of the website after that means you accept the amended terms, so it is worth checking this page from time to time.

These terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that hear appeals from them.

If any provision of these terms is found to be invalid or unenforceable, it is severed to the extent of the invalidity, and the remaining provisions continue to apply.

If we do not enforce a provision of these terms on a particular occasion, that is not a waiver of our right to enforce it later.
